Reasons
Punishment of the crime
On May 29, 2014, the Public Health and Medical Services Act, the Korean Public Officials’ Labor Union, the Korean Public Officials’ Union, the Korean Public Officials’ Union, the University Labor Union, the Local Public Officials’ Labor Union, the Central Public Officials’ Labor Union, the Senior Trade Union, the Korean Maritime Affairs Union, the Gyeongnam-nam Office of Education for the enhancement of public pension (hereinafter referred to as the “Public Service”), which consists of 50 or more organizations, such as the Public Officials’ Pension Assistance, the Public Officials’ Pension Assistance, the Busan Office of Education, the Nowon-gu Office of Education, and the Fire-Fighting Council (hereinafter referred to as the “Public Service”) started activities by holding a press conference before the Seoul Mine-gu Government Complex, and by holding a press conference on May 29, 2014.
1. No person who violates the Act on Assembly and Demonstration due to a violation of the place of assembly prohibition shall hold an outdoor assembly or demonstration at a place within one hundred meters from the boundary of the National Assembly;
Nevertheless, on May 1, 2015, from around 13:10 to around 14:10, the Defendant participated in the “Resolution for Resolution on the Stopover against the Violation of Public Official Pension Act” hosted by the public administration in India from the perspective of the Yeongdeungpo-gu Seoul Industrial Bank; from around 16:09 to 17:00 on the same day, the Defendant participated in an assembly held within a distance of 100 meters from the boundary of the National Assembly at a place within the boundary of the headquarters of the National Assembly.
2. The head of the police station having jurisdiction over the violation of the Act on Assembly and Demonstration due to a failure to comply with the dispersion order shall demand voluntary dispersion of an assembly or demonstration at a place where assembly or demonstration is prohibited within a reasonable time, and if the demand is not complied with, the dispersion order may be ordered; all participants shall, upon receiving the above dispersion order, be dissolved without delay;
Nevertheless, it is not possible.
