A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

1. On August 2014, the Defendant: (a) at an infinite general restaurant located in the Government of the Gyeonggi-do, the Defendant provided that “A high school-friendly job offering victim B shall pay the card price every month if he/she makes a credit card copy; (b) however, the Defendant was thought to have received a credit card under the victim’s name and used it as entertainment expenses, etc., without any property or income to pay the card price in a bad credit condition.”

Nevertheless, on September 4, 2014, the Defendant: (a) by deceiving the victim; (b) obtained one credit card (E) linked to the victim’s bank account (D) from the victim; and (c) settled 118,000 won from the “F Kinging practice room” on the same day; (d) from the above date and time to June 30, 2015, the Defendant paid a sum of KRW 36,250,400 with the said credit card over 191 times, as shown in attached Table 1, or obtained a short-term card loan.

2. A theft: (a) around 16:06 on June 24, 2015, the Defendant withdrawn KRW 1,000,500,000,000,000 from the date and time to July 4, 2015, and stolen the cash managed by the non-existence of the name belonging to the said HF association, by inserting the said credit card in cash withdrawal machine and inserting a password into the HF account as described in paragraph (1) on two occasions; and (b) withdrawing KRW 1,60,000,000,000 from the date and time to July 4, 2015.
