1. The plaintiff's claim that is changed in exchange in the trial is dismissed.
2. All costs of the lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On May 8, 2013, the Defendant received a decision on the commencement of rehabilitation procedures (the appointment of A as a custodian) by the Seoul Rehabilitation Court 2013hap85, and on August 3, 2017, the Defendant received a decision on the completion of rehabilitation procedures.
B. The Defendant: (a) awarded a contract for the Changwon-do STX KN 13BL, and 25BL construction project implemented in Changwon-si, Changwon-si, Changwon-si, Changwon-si, Changwon-si, a Co., Ltd.; (b) concluded each subcontract for reinforced concrete construction project among the above construction project (hereinafter “Do Young Construction”); and (c) as indicated below, with regard to reinforced concrete construction project among the above construction project:
(1) Of the construction works of 13BL 1 Section, reinforced concrete construction works among the construction works of this case, “the instant 2 construction works” and “the instant 3rd construction works” among the new construction works of 13BL 2 Section. [Attachment 1] The contract price (including value-added tax, including the new construction works) for the construction work of 13BL 1 Section, among the new construction works of 13BL 1 Section, on December 13, 2012 from December 13, 2012 to November 30, 30, 727, 870, 483BL 13 Section 2 Section 15, April 15, 2013 to April 15, 2014 to 30, 2014; 13BL 14.6, 2018; 15.37; 25.18.21, 2014
다. 피고는 로얄앤컴퍼니 주식회사로부터 화성시 팔탄면 율암리 154-2 일원에서 시행되는 화성공장 신축공사를 도급받고, 도영건설과 2013. 7. 4. 위 공사 중 철근콘크리트공사(이하 ‘이 사건 제4공사’라 한다)에 관하여 공사기간 2013. 7. 4.부터 2013. 8. 31.까지, 계약금액 10,538,000,000원(부가가치세 포함)으로 정하여 하도급계약을 체결하고, 2013. 8. 30. 공사기간을 2013. 7. 4.부터 2014. 3. 31.까지로 변경하였다
