Defendant shall be punished by a fine of two million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

On March 26, 2019, the Defendant brought a divorce and a lawsuit for division of property against the victim B and the married couple in around 2006.

1. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Violation of Information and Communications Network, etc.) shall intrude on an information network without access

Nevertheless, on November 2018, in order to identify the female relationship of the victim who was requested to divorce from the defendant's house located in Busan Shipping Daegu C apartment, and D around the day of November 2018, the defendant released the victim's password through his/her E account to the F account in his/her name.

Accordingly, the Defendant infringed upon another person’s information and communication network without access authority.

2. No person violating the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection shall damage another person's information processed, stored or transmitted through information and communications networks, or infringe, use or divulge

Nevertheless, the Defendant, at the time and place specified in the preceding paragraph, sent F-related text messages, which the victim exchanged with D, and the pictures taken by the victim together with D, to the Defendant’s cell phone. On August 2019, the Defendant submitted F-Related text messages, etc. to the Busan Family Court as evidentiary materials along with the preparatory documents claiming that the victim is a responsible spouse.

Accordingly, the defendant revealed another's secret processed and stored through the information and communication network.
