A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant was aware that he had been in common.

C, after receiving a proposal from D for the payment of gold bars to China or to Japan on the face of transporting them from China to Korea or from Korea without filing an export declaration, the gold bars were sealed from China to Korea in a way that it is difficult to detect metal 200g unit and passed through the security search stand, and the gold bars were sealed to export them to Japan in Korea.

1. The name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree shall be reported to the head of the relevant customs office when he/she intends to export, import or return the sealed imported goods;

Nevertheless, at around October 30, 2015, the Defendant entered the Incheon Airport by using letter SC4707, U.S., China, and imported five gold bars of 200g uniting 46,948,000 won at the market price (a sum of 1kg) at the port from 1,000 to 5, 26 times in total, as shown in the [Attachment] list of crimes from around that time to January 2, 2017.

Accordingly, the Defendant imported gold bars without reporting to the customs collector in collusion with C, D, etc.

2. The name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree shall be reported to the head of the relevant customs office when he/she intends to export, import or return the goods smuggling.

Nevertheless, the Defendant, at around March 5, 2016, departing from the Incheon Airport to the Incheon Nai Airport using letter 1085, thereby hiding five gold bars (onekg in total) of the market price of 53,526,000 won at the 200g unit of 200g unit of 53,526,000 won, which was requested by D to transport from D, and sealed and exported them into the port, and around that time, from around November 13, 2016 to around November 13, 2016, using the same method as a list of crimes (tight export) in the attached Form 362,956,000, total market price of seven times in total, such as a list of crimes (tight export).
