A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant, who came to know of the introduction of B, proposed that he would pay gold bars to Korea from China to Korea or from Korea to Japan without filing an export declaration from C which he knew of the introduction of B, and that it is difficult to detect metal, thereby tightly importing gold bars from China to Korea in a way of inserting 200g ness of ness of ness of 200gs and passing through the security screening stand, and had the intention to export gold bars to Japan from Korea to Japan.
1. The name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree shall be reported to the head of a customs office when he/she intends to export, import or return gold-free imported goods;
Nevertheless, around August 21, 2015, the Defendant: (a) concealed five gold bars at the port of 200g unit of 48,510,000, the market price of which was requested for transportation by C when entering the Incheon Airport via Dair E in China; and (b) imported a total of 61 km of total market price of 2,875,840,000 won from around that time to January 6, 2017, as shown in the attached list of crimes (Smuggling).
Accordingly, the Defendant imported gold in collusion with C, etc. without reporting to the head of the customs office.
2. The name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree shall be reported to the head of a customs office when he/she intends to export, import or return the sealed goods;
Nevertheless, around April 22, 2016, the Defendant: (a) concealed five gold bars (total 1kg) equivalent to the market price of KRW 50,600,000 in the unit of KRW 200,000 in the unit of KRW 50,60,000 in the market price of KRW 50,000 from the Incheon Open Port to the Japanese Nata Airport; and (b) sealed and exported them into the port; and (c) from around that time to May 10, 2016, the Defendant, as shown in the attached list of crimes (Smuggling) together, 2 kmg of total market price of KRW 102,740,00 in the total of two occasions.
