The defendant shall be innocent.
Reasons
1. On December 16, 2010, the Defendant: (a) received a successful bid for C’s ground housing at drinking on an auction on December 16, 2010; (b) did not link the said housing and the road on the cadastral map with the road on November 15, 1989; (c) used that the real estate indication column for the real estate sales contract for the 13 square meters (43 square meters at the present PPH) in the Yong-gun-gun G (hereinafter “instant land”) located in the said housing and the road on the cadastral map, in a way that the real estate indication column for the real estate sales contract for the 13 square meters (43 square meters at the present PP) is a disturbance, thereby gathering a street on the land of 43 square meters in the said housing and the road on the cadastral map.
From August 2012 to October 18, 2012, the Defendant altered a private document, which is a private document related to rights and obligations, with the intention of using each unmanned on the buyer E, F, and E’s name, entered the real estate sales contract in the real estate marking column under the said real estate sales contract after obtaining the real estate sales contract from J, the wife of E, as a result of November 15, 1989, into the real estate marking column under the said real estate sales contract, and revised one copy of the real estate sales contract under the name of D, F, and E without authority.
B. On October 18, 2012, the Defendant filed a lawsuit claiming the ownership transfer registration of the instant land in the Gwangju District Court’s Netcheon-si, Gwangju District Court’s Da, K, and F, accompanied by the written complaint, and subsequently submitted to the said court as if the said party was a document duly formed by the relevant real estate sales contract, and exercised it.
C. On October 18, 2012, the Defendant, who attempted to commit fraud, submitted a modified real estate sales contract with the Gwangju District Court, even though he was aware that D had not sold the instant land to E and F, a complaint stating that “F and K purchased the instant land from E and they purchased the instant land from F, K, and the network D bears the obligation to transfer the ownership of each of the instant land to F, K, F, and K.”
