A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[2017 Highest 815] On February 5, 2017, the Defendant would sell BG contact diskettes in order to sell money to the victim BH who reported and contacted by posting a sales letter "BG wing wing wing Conspons" on the Internet among BFPC trading sites.

A false statement was made.

However, even if the defendant receives money from the injured party, the defendant did not have the intent and ability to transfer the contact diskettes to the injured party.

As such, the Defendant, by deceiving the victim, received 220,000 won from the victim under the name of BI bank account (BJ) in the same day, from the victim. From December 28, 2016 to February 6, 2017, the Defendant was issued KRW 2,095,000 by deceiving the victims over 15 times as indicated in the list of crimes in the attached crimes.

[2017 Highest 1015] Around January 4, 2017, the Defendant posted a letter of sales that sold Ga5 mobile phone at the Internet’s home of the defendant, Nam-gu, Incheon, Seoul, the defendant sold the mobile phone to the victim BL who reported and contacted, and expressed his/her intent to sell the mobile phone to the victim BL.

However, even if the defendant received money from the injured party, he did not have the intention or ability to sell the mobile phone.

The Defendant received 380,000 won from the victim to the post office account (Account Number D) in the name of the Defendant on the same day from the victim, and acquired 518,000 won from the victims through the same method from December 9, 2016 to the above time.

[2017 Highest 1063] Around February 5, 2017, the Defendant posted a letter on the Internet’s “BF” room located in the Southern-gu Incheon Metropolitan City BE to sell the “BG” container in the middle and high country car page, which is an Internet trading site, to the victim BM who reported and contacted around February 6, 2017.
