The prosecution of this case is dismissed.

1. 공소사실 피고인은 2019. 12. 24. 성남시 중원구 B에 있는 피고인의 회사에 설치된 컴퓨터를 이용하여 C에 ‘D’이라는 닉네임을 사용하여 접속한 후, 닉네임 ‘E’ 사용자가 그곳 게시판에 피해자 F(28세)을 비방하는 내용의 ‘G 들어가서 욕만 먹고 왔다’라는 게시글에 피해자를 지칭하여 “이 새끼 H로 길 알려주는 거 올릴 때도 옆에 구경하면서 뒤로 점프하더라 ㅋㅋ 싸이코패스인 줄 뒤로 가는데 길을 어떻게 알아 씨발 진짜”라는 댓글을 작성, 게시하여 공연히 피해자를 모욕하였다.

2. Determination

(a) Applicable provisions of Acts: Article 311 of the Criminal Act;

(b) An offense subject to prosecution upon complaint: Article 312 (1) of the Criminal Act.

(c) Revocation of complaint filed by a victim after public prosecution is instituted (receiving on April 27, 2020);

(d) Judgment dismissing public prosecution: Article 327 subparagraph 5 of the Criminal Procedure Act;
