A defendant shall be punished by imprisonment for not less than two years and six months.
However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
In 2020 High-Ma3082, the name-free statement made a false statement to the victims of an unspecified number of victims, such as “a loan is possible, and if the existing loan is not repaid, the violation of the Act should first be repaid,” and “an inducement” of the telephone financial fraud organization (i.e., “Ssing”) which takes money through the receipt of cash from the victims. The Defendant conspired to commit the crime of using name-free statement and scam by calling the victims as if they were the employees of financial institutions, etc. according to the orders of the victims of the above name-free statement, and by remitting cash from the victims to the account known by the victims of the above name-free statement to the account, etc.
