1. The Defendant’s KRW 77,566,307 and its related KRW 5% per annum from September 13, 2014 to December 8, 2016 to the Plaintiff.

1. Basic facts

A. (1) On May 19, 2012, the Plaintiff concluded a comprehensive insurance contract (hereinafter “instant insurance contract”) with D who leases a store located in Seongbuk-gu, Seongbuk-gu, Sungnam-gu (hereinafter “victim”) to operate a mutual restaurant (hereinafter “C”).

B. Fire occurrence and damage (1) around 02:40 on December 4, 2012, the fire (hereinafter “instant fire”) occurred inside the instant store, and the occurrence of the damage caused by the fire, such as the concentration of equipment, facilities, etc. inside the damaged store, which is moved to an adjacent building, in turn, was destroyed.

(2) Due to the instant fire, D suffered losses in total amounting to KRW 51,60,50,000, and KRW 75,324,00,00 in the damaged shop; and KRW 156,084,228,00 in total amount of business losses, etc. equivalent to KRW 29,09,728.

C. (1) The National Scientific Investigation Agency’s opinion on the cause of the fire at the relevant agency (1) considers the type of burning a fire site and the location of the electrical distinctive points, the point of launching can be limited to the main part of the instant shop, and the point of launching can be excluded by human factors, the possibility that it was generated by the electrical heat or the flame that was generated in the process of forming a scopic scopics identified in the electrical wires located in the main part of the instant shop.
