The prosecutor's appeal is dismissed.

1. In light of the gist of the grounds of appeal in this case, B merely instructed the sexual relationship between the Defendant and F

in the light, as well as the background why B instructed the sex relationship between the Defendant and F, and as of December 26, 2016.

The first gender relationship was around February 25, 2017, around January 21, 2017

It is necessary to make more careful judgments on whether it should be seen differently from the third gender relationship.

However, the judgment of the court below that acquitted the defendant on the ground that the above three-time sexual relations are comprehensively considered, is erroneous in the misconception of facts.

2. The summary of the facts charged in the instant case reveals that the Defendant: (a) around December 24, 2016, upon request from high school-friendly B to find out the jobs in the water zone; and (b) from around 16 months, the Defendant was discovered to B that he/she had sexual intercourse with F and B over three times during the period of 16 months, who were the husband of B, at the home of B located in Osan City, I; and (c) accordingly, the Defendant and F prepared evidence of a divorce lawsuit one time with his/her hand, and took a photograph of the Defendant and F immediately after the sex relationship.

Since then, the Defendant, upon leaving the Defendant’s birth to the Defendant’s birth, received the above resistance from the Defendant’s birth G, told the said G to the effect that “I would unfasten the pictures taken by the Defendant without the Defendant’s death,” and had seeed B to the effect that “B would unfasten the pictures taken by him.”
