1. The Defendant calculated the Plaintiff’s annual interest rate of KRW 83,697,462 and the annual interest rate of KRW 15% from May 28, 2017 to the date of full payment.

The Plaintiff supplied a car paint to the Defendant on March 23, 2017; the Defendant paid KRW 83,697,462 to the Plaintiff on April 30, 2017; however, the Plaintiff shall pay KRW 10 million to the Plaintiff on April 30, 2017 and KRW 5 million on the last day of each month from May 31, 2017. If the payment of the installment is in arrears at one time, the Plaintiff agreed to lose the benefit of the period; the Defendant did not pay the said installment at all to the Plaintiff; thus, the Defendant is liable to pay to the Plaintiff the amount of KRW 83,697,462 as well as damages for delay calculated at the rate of KRW 15 percent per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the day following the delivery date of a copy of the complaint of this case sought by the Plaintiff to the day of full payment.

Therefore, the plaintiff's claim shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
