A defendant shall be punished by imprisonment for one year.

Punishment of the crime

A. The Defendant is a person who actually operates the above company as the representative director, who is a school meal service, food manufacture, D, or E, which is a distributor of food materials.

In response to an electronic bid for supplying food materials "Food and Food Industry Exchange" operated and managed by the Korea Agriculture and Food Trade Corporation (EA), the Defendant shall not lend the name of other companies or make a bid for the same public announcement in the same area. However, the Defendant prepared ten food materials suppliers, such as O, P, Q, S, S, T, U,V, P, and W, in addition to the above two food materials suppliers directly operated by the Defendant, in order to establish a disguised company under the name of relatives, employees, etc. for the purpose of raising the successful bid rate by participating in the electronic bid for the aforementioned "Food and Food Industry Electronic Procurement System" due to an increase in the number of enterprises participating in the electronic bid for the above "Food and Food Industry Promotion System", and prepared ten food materials suppliers, such as F, G, H, H, K, K, L, S, Ma, N, etc.

On October 17, 2014, the Defendant received a successful bid in KRW 27,925,000 in the name of theO, by making duplicate announcements in the name of E andO, the same business entity that is actually managed and operated by the Defendant, in participating in the electronic bidding “public announcement of submission of estimates of small amount of Z, elementary school 11 months (agricultural, industrial products, kimchi, and fishery products)” that is ordered and managed by the above construction.

In addition, from around that time to October 23, 2015, the Defendant received a bid for school meal service supply contracts equivalent to KRW 6,612,559,669 in total in the name of the same company that the Defendant managed and operated the same electronic bid through the above method 262 times, such as the list of crimes (1) as indicated in the attached list of crimes (1) from around that time to around October 23, 2015, and followed the fairness of the electronic bid for "School Meals Electronic Procurement System
