1. The Defendant’s each of the Plaintiffs’ KRW 10,641,690, as well as 5% per annum from June 27, 2017 to July 4, 2018.

Reasons

1. Facts of recognition;

A. G died on March 4, 2017, and his/her lineal descendants shared inheritance at the rate of 1/8 shares, respectively, by the successors of the Plaintiffs, the Defendant, H, and the deceased I, who were their lineal descendants.

G acquired five real estate (hereinafter referred to as “real estate of this case”) as follows, and disposed of it to the Defendant and I.

C.1) On June 9, 2008, G: (a) donated the instant title 2 through 5 to I and completed the registration of ownership transfer; (b) on October 10, 2008, the Defendant filed a lawsuit against I on the instant title 1 through 5 with regard to the instant real estate, claiming for the registration of ownership transfer on the grounds of payment in kind on March 5, 1978; (c) on November 11, 2010, the Defendant voluntarily withdrawn the lawsuit against G, I, and P, including the cancellation of ownership transfer registration, with regard to the instant title 1 through 4 real estate; (d) the implementation of the procedure for the cancellation of ownership transfer registration on the instant title 1 through 4 real estate; and (e) the implementation of the procedure for the registration of ownership transfer on the grounds of payment in kind on March 5, 1978; and (e) withdrawal of the lawsuit against G on March 15, 2011.

3. On April 1, 2011, the Defendant cancelled the registration of the above provisional disposition on the real estate Nos. 1 through 5 of this case.
