피고인은 2014. 4. 27. 23:59경 서울시 C에 있는 D 편의점 내 진열대에서 물건을 구매하고 있는 피해자 E에게 다가가 "내가 좋은 자리를 마련해 놨으니 얼른 와라"며 추근대고 불쾌함을 표현하는 피해자에게 "대학을 나왔냐, 씨발년아."라며 편의점 종업원 F가 카운터에서 들을 수 있을 정도의 큰 소리로 욕설하여 공연히 피해자를 모욕하였다.
