A defendant shall be punished by imprisonment for four months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 도박 개장 피고인은 2016. 9. 24. 22:00 ∼23 :10 경 인천 남구 B에 있는 피고인의 단독 주택 집에서 C에게 담뱃값, 기름값 등 명목으로 돈을 챙겨주기로 하면서 망을 보는 속칭 ‘ 문방’ 역할을 하게 하고, D, E, F 등 약 20명으로 하여금 미리 준비한 화투 20 장을 사용하여 화투 5 장씩을 1패로 하여 총 4패로 나누고 ‘ 오야’ 의 패를 제외한 나머지 3패 중 도박에 참여한 사람들이 임의로 선택한 패에 1만 원에서 5만 원까지 도금을 건 다음 분배된 화투 5 장 중 3 장으로 10이나 20을 만들고 나머지 2 장의 끝수에 따라 승패를 결정하는 방법으로 수십 회에 걸쳐 속칭 ‘ 줄 박( 변형된 도리 짓고땡)’ 이라는 도박을 하게 하고, 장소 사용료 등 명목으로 도금의 일부를 받기로 하였다.
