1. The Plaintiff, Defendant B, Defendant C, Defendant C, KRW 19,280,00, and Defendant D, KRW 20,264,60, and each of the said money.
Reasons
1. The facts below the facts of recognition do not conflict between the parties, or may be admitted as a whole by the witness E's testimony on each of the statements in Gap 1, 2, 4, 5, 7 to 10, 16 to 18, 20 to 22, 24 to 27, and 29 to 32.
The Plaintiff is a person who provides elderly long-term care services from March 2009 to the name of "G" on the F and the second floor of Yangcheon-gu Seoul (hereinafter referred to as the "Center in this case").
B. The Defendants are caregivers who enter into a long-term employment contract with the Plaintiff and provide visiting medical care services to the instant center.
C. As a result of an on-site investigation conducted by the Plaintiff on May 11, 2015 between the National Health Insurance Corporation and the Yangcheon-gu Office, the Plaintiff was found to have received the total of KRW 183,872,050 for the period from September 1, 2010 to March 31, 2015.
In other words, while the Plaintiff operating the instant center, the caregivers of the instant center, including the Defendants, increased the number of days and the number of times as if they provided visit care services to the beneficiaries without actually providing visit care services, and falsely prepare records of the provision of long-term care benefits and records of the changes in the state, and submit them to the Plaintiff. Based on such false data, the Plaintiff was unfairly paid KRW 183,872,050,050 as expenses for long-term care benefits by the National Health Insurance Corporation.
The Defendants received each of the following amounts from the Plaintiff under the pretext of the payment, as if they provided the visiting care service not actually provided as above:
Amount of benefits paid during the pertinent period from January 201 to March 16, 2015, to March 16, 2015, KRW 2320, KRW 2350 from September 201 to March 20, 2015, KRW 3D 3D 3D 20,201 to April 20, 2015.
D. On July 1, 2015, the National Health Insurance Corporation paid the Plaintiff unfairly excessively.
