A. T matters pertaining to the location, disposal capacity, time of completion, installation agency, etc. of T is a waste incineration facility with a daily disposal capacity of 900 tons located in U.S., which was completed on December 31, 2001 through the Examinationdong from October 200, and the Defendant Mayor is an agency installing Telecommunication, which is a waste disposal facility under the Act on the Promotion of Installation of Waste Disposal Facilities and Assistance, etc. to their Environs (hereinafter “Waste Facilities Promotion Act”).

B. Matters concerning residents and the plaintiffs residing in the affected neighboring areas 1) Article 17-2 of the Waste Facilities Promotion Act, Enforcement Decree of the Act on Promotion of Installation of Waste Disposal Facilities and Assistance, etc. to their Environs (hereinafter “Enforcement Decree of the Waste Facilities Promotion Act”).

The purpose of Article 18(1) and attached Table 2 subparag. 2(b) is to “G’s name local governments (hereinafter “instant organizations”) with the purpose of “the residents of Seoul V, who are affected environmentally due to the installation and operation of waste disposal facilities, to minimize all damage caused by the T operation and to make maximum management of the rights and interests of V residents, thereby enhancing their quality of life and protecting as much as possible from environmental impact.”

On July 30, 1996, the following self-governing rules (hereinafter “instant rules”) are established.

The provisions of Chapter I of the General Provisions of Chapter I of this Committee are established and implemented on the basis of G. The name of this Committee is referred to in Article II (Name).
