Defendant
A Co., Ltd. is a corporation that runs the construction business at the above location; Defendant B is an employee of Defendant A; Defendant C is a corporation that runs the civil engineering and construction business at the above location; Defendant D is an employee of Defendant C.
Defendant
The Co., Ltd. ordered “G Corporation” from Ydo-gun to award contracts to Defendant A, and Defendant D, as the site warden of Defendant C, was responsible for the management of safety and health by comprehensively controlling the work direction and safety and health of its employees from around October 24, 201 to around May 14, 201 as the site warden of Defendant A Co., Ltd., and from around May 14, 2014, Defendant B, as the site warden of Defendant A Co., Ltd., taking charge of the management of safety and health.
1. Defendant B
(a) Where a business owner or his/her employee performs the work of handling heavy objects using a vehicle-based construction machine, he/she shall prepare a work plan in order to prevent any danger to workers, and designate a work conductor and have him/her direct the work in accordance with the work plan;
Nevertheless, at around 13:05 on August 6, 2015, the Defendant: (a) prepared a work plan stating the order of work, such as the victim I (I, 21 years old) and J (59 years old); (b) prepared a work plan to designate the signal number as the victim J; and (c) designated KK as the leader; (d) conducted work with four employees, including the victim I (I, 21 years old) and J (59 years old); (c) performed the work of dismantling the signal board with the weight of 350km of the opening; and (e) performed the work of dismantling the signal number as the victim J; and (e) completed the work plan to designate the signal number as the victim's leader; and (e) conducted the work without immediately concluding the work plan to immediately close the safety of the signal board.
