Reasons
Punishment of the crime
Defendant
A is the captain of the shipment E (39 tons, inshore fishing) at the Gyeong Young-gun, and the defendant B is the captain of the loading F (29 tons, inshore fishing) at the Gyeong Young-gun, and the defendant C is the owner of E and F.
1. No defendant A fishing vessel shall be used to assist another fishing vessel engaged in any other fishery business by the means of fishery permitted to the relevant fishing vessel;
Nevertheless, around October 8, 2014, the Defendant: (a) upon receiving a request from the captain of G (59 tons, shipments in the case of the Gyeongbuk-gun; (b) in order to capture crypted fish at the sea at the east on the east of the East coast; (c) collected crypted fish on the surrounding sea by indicating crypted fish, etc. in order to capture crypted in a large quantity; and (d) collected 70 households (one household is x 48 cm in width and 34 cm in width; hereinafter the same shall apply) from the time from December 12, 2014, the Defendant captured the crypted fish, etc. on the surrounding sea by gathering crypted fish, etc., which is the method of fishery permitted by E, using traw gear to capture 70 households (one household is x 72cm in width, 48 cm in length and 34 cm in the 2014.

Nevertheless, the Defendant, at around October 5, 2014, on board the sea at the east of the East coast and engaged in the offshore fishing operation, was requested by the captain of G (59 tons, the shipment in the case of the Gyeongbuk-gun, and the East Sea Zone) to clarify the collected fish, etc. in order to capture a large amount of radioactive fish from H, and the Defendant, upon receiving a request from the captain of the G (59 tons, the loading in the case of the Gyeongbuk-gun-gun, the East Sea Zone) to gather the radioactive fish on the surrounding sea, which is a method of fishing permitted by F, so that H may capture 70 households of radioactive fish, regardless of whether H was caught by using tls fishing gear on the sea around the F, from that time to December 8, 2014, as described in attached Table 21 (2).
