Defendants shall be punished by imprisonment for six months.

However, each of the above defendants is against the defendants for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. Defendant A is the owner and captain of the fish plantation C (7.93 tons) and is engaged in fishery as the owner and captain of the fish plantation C (7.93 tons) in the front-west high-sea.

No fishery right holder designated as a control vessel shall use a control vessel for catching, gathering, or cultivating marine animals or plants on waters other than the designated fishing ground area or fishing ground area approved for use.

Nevertheless, from around 06:10 on July 6, 2018 to 12:10 on the same day, the Defendant collected approximately KRW 300 km (or KRW 4.5 million at the market price) using the above C, which is a management line, from the front public waters in front of the Dondo-gun, Jeonnam-do-gun, the fishing village fraternity E, which was a fishing ground area approved for use from around 06:10 on the same day, and the same month.

From 06:10 to 12:55 of the same place, using the above C, approximately KRW 1600 km (market price equivalent to KRW 2.4 million) was collected from around 06:10 of the same month to around 07:00 of the same place, using the above C, and collected approximately KRW 620 km (market price equivalent to KRW 9.3 million).

Accordingly, the Defendant used a control vessel to capture, gather, or cultivate marine animals and plants on the waters other than the fishing ground area approved for use.

2. Defendant B is the lessee and captain of the Myeon (4.97 tons) of the Donnam-do Don-do Donon Don-do Donon G (4.97 tons

No fishery right holder designated as a control vessel shall use a control vessel to capture, gather, or cultivate marine animals or plants on waters other than the designated fishing ground area or the fishing ground area approved for use thereof.

Nevertheless, the Defendant, from July 6, 2018 to December 12:10, 201, captured and gathers marine animals and plants on the waters other than the approved fishing ground area by collecting approximately KRW 3,000 g (market price equivalent to KRW 4,500,000) using the above G, a control line, from the front public waters in front of Ydo-do-gun, a fishing village fraternity E, which is a fishing ground area approved for use from around 06:20 to around 15:10.
