The grounds for appeal by the plaintiff and the defendant citing the judgment of the court of first instance are not significantly different from each argument in the court of first instance, and even if the evidence submitted in the court of first instance was presented to this court, the recognition and judgment of the facts in the court of first instance can be deemed legitimate.

Therefore, the reasoning of this court's judgment is the same as that of the first instance judgment except where "the plaintiff" in Part 6 of the judgment of the court of first instance is deemed "the defendant," and therefore, it is accepted by the main sentence of Article 420 of the Civil Procedure Act.

2. The judgment of the first instance is justifiable, and all appeals by the plaintiff and the defendant are dismissed.
