A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On March 17, 2014, the Defendant was sentenced to imprisonment with prison labor for the crime of attempted fraud, etc. at the Seo-gu District Court Branch of the Daegu District Court for the period of four months, and the said judgment was finalized on the 25th of the same month.

On June 2013, the Defendant read and contacted a letter stating that “I will get money from the name of the Defendant. I want to get money from the name of the Defendant,” and conspired to receive a mobile phone from a wholesaler supplying a mobile phone and receive the mobile phone from the Defendant.

1. On June 2013, the Defendant: (a) at the “E” mobile phone sales store registered in the name of the Defendant located in Ansan-gu, Ansan-si; and (b) even if the Defendant was supplied with the mobile phone from the victim, the Defendant made a false statement to the effect that he did not intend or have the intent to sell the mobile phone; (c) however, the Defendant was issued a mobile phone 28 mobile phones equivalent to KRW 24,211,00 at the market price from around 25th of the same month to July 3, 2013 from around 2013 to around July 3, 2013 from the victim.

Accordingly, the defendant was given property by deceiving the victim.

2. On June 5, 2013, the defrauded of the Victim G calls to the victim H operated by the victim G, and told the victim to the effect that “the victim is fine for the introduction of the victim. I want to enter into a contract for mobile phone consignment sales and trade.”

However, even if the defendant was supplied with a cell phone from the victim, he did not have the intention or ability to sell it and pay the price to the victim.

As above, the Defendant deceivings the victim, and up to July 4, 2013, up to 8,663,60 won at the market price from the victim, nine smartphones are worth 8,663,60 won.
