1. The plaintiffs' primary claim and the conjunctive claim are all dismissed.

1. Basic facts

A. On October 25, 1975, the former 1,456 square meters of Chungcheongnam-gun G was divided into 871 square meters prior to G and 585 square meters prior to H (5 square meters prior to H is divided into 942 square meters prior to H on April 5, 2006, 48 square meters prior to I, 85 square meters prior to J, and 59 square meters prior to K).

B. The former G was divided into KRW 871 on November 28, 1975, by an application for division of land, and was divided into KRW 653 on February 9, 1976 and KRW 218 on September 9, 1976.

C. The previous G 653 square meters (2,159 square meters) was divided into 1,984 square meters (600 square meters; hereinafter “instant land”) prior to G on May 4, 1993 and 175 square meters (53 square meters) prior to N pursuant to the application for subdivision of M.

On the other hand, the O died on January 22, 1967, and the heir P, Q, R, the defendant, S, S, T, and U registered co-ownership on the ground of the inheritance of property between G 871 on December 15, 1975 and G 558 on December 15, 1975, and the ownership transfer registration was completed on the same day under the sole name of the defendant, and the defendant is currently the owner of the land of this case.

E. M filed an application with Suwon District Court 94Kadan1230 with respect to the instant land and N, and filed an application for provisional injunction on November 26, 1994. However, upon the Defendant’s application for provisional injunction, M was revoked on June 21, 2103 by Suwon District Court 201Kadan1094 on June 21, 2103.

F. M has died in around 1998 and succeeded to M by Plaintiffs C, D, E, and A, who are the spouse of M.

2. Assertion and determination

A. (1) On November 27, 1975, M&, the primary cause of the claim of the Plaintiffs, entered into a sales contract with the Defendant to purchase 600 square meters (1,984 square meters) out of the total 1,456 square meters of the G G 1,456, Chungcheongnam-gun, Chungcheongnam-gun, and the Defendant to purchase 31 Gama at 8,000,000,000 on the date of the contract, and pays the Defendant a down payment of 10 Gama (205,000 won) and the late payment of 10 Gama and 11 mama.
