가. 업무방해 피고인과 K, L은 피고인이 교도소에서 출소한 이후인 2011년 가을 무렵 02:00경부터 같은 날 02:20경까지 안동시 H에 있는 피해자 M이 운영하는 ‘N’ 식당에서 술을 마시던 중 다른 테이블에서 술을 마시고 있던 남녀 대학생 5~6명에게 “시끄러우니까 조용히 해라”라고 말하였으나 그 중 한 명이 “왜 그러십니까”라고 대답을 하자 겁을 주어 조용히 시키기로 하고서, 피고인과 K, L은 “이 새끼들, 뭘 쳐다봐”라고 말하면서 때릴 듯이 일어섰다가 앉으면서 원형테이블을 엎고, 피고인은 주먹을 쥐고 때릴 듯한 자세로 겁을 주고, K은 윗옷을 벗어 던지며 “씹팔새끼들”이라고 욕을 하고, L은 소리를 지르며 욕설을 하는 등 소란을 피웠다.
