On April 27, 2012, the Defendant subscribed to, and registered as, a seller the Internet file sharing site, and “W.Dooisk.co.,” “W.C”, around April 27, 2012, the Defendant joined the Internet file sharing site, and registered as a seller.

No person shall infringe the right of author's property of another person by means of reproduction, public performance, public transmission, exhibition, distribution, lending, or production of derivative works.

피고인은 성남시 분당구 E건물, 3층(F빌딩)에 있는 피고인의 전 회사 사무실에서 컴퓨터를 이용하여 위 오디스크 사이트에 접속한 후, 2012. 5. 11.경부터 2012. 9. 3.경까지 영상저작물인 방송프로그램 “무신(KBS)", "넝쿨째 굴러온 당신(KBS)", "런닝맨(SBS)"을 비롯하여, ”청담동 살아요(JTBC)“, ”응답하라 1997(tvN)" 등 별지 범죄일람표 기재와 같이 저작재산권 보호대상 영상저작물인 영화 등 비제휴저작물 1,533개를 복제한 후, 이를 위 오디스크 사이트에 업로드하여, 불특정 다수의 동 사이트 회원들이 총 91,533회에 걸쳐 이를 다운받을 수 있도록 하였다.

As above, the Defendant habitually infringed the copyright holder’s right of reproduction and public transmission, which is the author’s property right, by reproducing and publicly transmitting a cinematographic work including a broadcast program without the consent of the copyright holder.
