피고인은 2011. 11. 8. 천안시 동남구 B아파트 2동 1401호에 있는 피고인의 주거지에서, 인터넷 파일공유사이트인 “짱파일(www.jjangfile.net)”에 아이디 “C”로 접속하여 피해자 성명불상자의 저작물인 ‘the secret circle'을 위 사이트의 회원들로 하여금 다운로드할 수 있도록 게시한 것을 비롯하여 그 무렵부터 2013. 9. 23.까지 위 “짱파일”, “티디스크(www.tdisk.com)”, “케이디스크(www.kdisk.co.kr)”에 별지 범죄일람표 기재와 같이 피해자들의 저작물을 게시하였다.
