1. The Defendant’s KRW 1,304,590 with respect to the Plaintiff and KRW 6% per annum from August 20, 2019 to August 20, 2020, and thereafter.

1. Basic facts

A. The status of the Plaintiff is a corporation that engages in the manufacture and sale of ELD lamps, etc.

The defendant is a person who operates a personal business entity with a trade name "C" that is supplied with PE lamps, etc. from a manufacturer and engages in online marketing and sale.

B. On March 17, 2015, the Plaintiff: (a) supplied the Defendant with the ED lamps manufactured or imported by the Plaintiff; and (b) the Defendant entered into a contract with the Defendant under which the Defendant has exclusive sales rights for online sales, such as the Internet shopping mall in the ED lamps and home shopping (hereinafter referred to as “first contract”).

(1) The Plaintiff and the Defendant enter into a contract with respect to online sales on the manufacturing and distribution (LEDp-related products) of the Plaintiff. The Plaintiff and the Defendant enter into a contract with respect to online sales on the basis of the following: (i) the Plaintiff’s online marketing and sales on the manufactured or imported product; (ii) the Plaintiff’s online marketing and sales on the product; (iii) the Plaintiff’s manufacture or import of the product; (iv) the product certification and distribution license; (iv) the product certification and distribution license; and (v) the product certification and distribution license of the Plaintiff’s supply to the Defendant do not have any problem with electrical safety and quality under domestic and foreign laws; and (v) the product is a normal product with no problem with distribution license. 6 The scope of the transaction is as follows: The Defendant has exclusive sales license and sales authority for online sales, such as online shopping mall and home shopping; and (iv) the Plaintiff shall be held liable for any defect in its inherent functions and sales license; and (v) the Plaintiff shall be held liable for any defect in its sales license and sales license.
