A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On December 29, 2011, the Defendant was sentenced to imprisonment with prison labor and four months at the Seoul Central District Court for fraud, etc., and the said judgment became final and conclusive on January 6, 2012.
1. On July 31, 2007, while operating the Home Shopping Co., Ltd., the Defendant, at the office of the victim E located in Gangnam-gu Seoul Gangnam-gu Seoul, said, the Defendant said to the effect that “When investing money in the Fund, the Defendant would have made an investment in the Company’s Home Shopping around October 10, 2007 to sell the Jindo container, which he has the power to sell and distribute the proceeds. First of all, the cost of producing the video for the Home Shopping Broadcasting need to be invested in the money.”
However, there is no fact that the Defendant was running a sales business of the Jacker Home shopping around that time, and there was no intention or ability to sell the proceeds or distribute the proceeds, considering that the Defendant was able to use the proceeds to repay personal debts from the victim.
As such, the Defendant, by deceiving the victim as such, received money totaling KRW 13,300,000, including (12,500,000,000 on July 31, 2007, and (80,000,000 on August 17, 2007, from the national bank account (Account Number:F) under the name of the victim as investment money from the victim.
2. Around October 4, 2007, the Defendant, at the victim E office as stated in paragraph (1) of this Article, told the victim to the effect that “I will distribute 60% of the profits from the investment of money in the business of dyeing drugs to the Republic of Korea, with the right to sell dye sye sye sye sye sye sye sye sye sye sye sye sye sye syes
However, there is no fact that the defendant has been running a chrops sales business at that time, and it is thought that he will use the money to pay his personal debt, and even if he receives money from the victim, he will receive money from the victim.
