Criminal facts
[Basic Facts] Defendant A’s denial of H who was elected as a candidate for the head of the relevant Si/Gun at the Net Chang-gun’s reelection conducted on October 26, 2011. Defendant B was the representative director of the limited liability company I, the former construction company, and Defendant C was the person in charge of accounting of the said H from August 19, 201.
In addition, the above H retired as a candidate for the head of the Gun on August 14, 201, and registered as a preliminary candidate on or around October 6, 201, and thereafter elected as the head of the Gun on or around October 26, 201, following the registration of the candidate on or around October 6, 201.
【Criminal Facts】
1. Defendant A and Defendant B gathered to use election expenses without going through a person in charge of accounting for the purpose of winning a H that was released as a candidate for the head of the Gun in relation to the re-election of the head of the Gun in a place where it is not known that around July 2011, Defendant A and Defendant B were not known, and some of the expenses were to be supplied by Defendant A, and some of the expenses were to be settled after the settlement.
Although the revenue and expenditure of the political funds of the candidate for the election of public office and the preliminary candidate can be made only by the person in charge of accounting, Defendant B, as seen above, purchased at KRW 2,775,00,00, around August 17, 201, and offered it to the above H election office in the JJ of the former Ham Chang-gun, as well as from October 31, 201, used the total amount of KRW 95,431,087, in total, 54 times from October 31, 201, as shown in the list of crimes, as political funds, to select H as the person in charge of accounting.
As a result, the Defendants conspired to pay political funds even if they were not the person in charge of accounting.
2. Defendant C
(a) Any candidate to run in an election for public office and any person in charge of accounting of a preliminary candidate in connection with an accounting report shall make an accounting report on the revenues and expenditures of political funds to the competent election commission not later than 30 days after the election day as of 20 days after the election day, and election expenses without justifiable grounds;
