1. The Defendant’s KRW 33,619,172 as well as the Plaintiff’s KRW 20% per annum from June 23, 2015 to September 30, 2015.

1. Facts of recognition;

A. The Plaintiff, a company established for the purpose of selling chemical drugs, etc., was not paid KRW 33,619,172 as the price for the goods until December 18, 2014 while supplying chemical drugs, etc. to the Defendant for several years.

B. On April 24, 2015, the Defendant drafted a letter of payment with the purport to pay 3,619,172 won for the said unpaid goods to the Plaintiff by May 15, 2015.

According to the facts of the above recognition, the Defendant is obligated to pay to the Plaintiff the amount of KRW 33,619,172, and the damages for delay calculated at the rate of 20% per annum from June 23, 2015 to September 30, 2015, which is the day following the delivery of a copy of the complaint of this case, and 15% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.

3. In conclusion, the plaintiff's claim is justified and it is so decided as per Disposition.
