1. The Plaintiff:

A. Defendant B’s KRW 125,027,00 and for this, KRW 20% per annum from August 8, 2015 to September 30, 2015;

Basic Facts

The plaintiff is a company established for the purpose of souping, related incidental business, camping business, etc.

Defendant B is the Plaintiff’s colon and the Plaintiff’s auditor, who is the Plaintiff’s representative director, and Defendant C is the representative director of E (hereinafter “E”) established for the purpose of construction, equipment business, etc.

On August 24, 2005, Defendant B made a registration of preservation of ownership on the real estate listed in the separate sheet (hereinafter “instant real estate”) on August 24, 2005, and on October 11, 2006, Defendant B made a registration of establishment of a mortgage on the instant real estate with a loan obligation of KRW 195,00,000 to our bank (hereinafter “Korean bank loan obligation”) as the secured obligation, and completed a registration of establishment of a mortgage on the instant real estate as Defendant B with a maximum claim amount of KRW 234,00,000,000 against our bank as the secured obligation.

Meanwhile, from November 13, 2006 to September 26, 2012, Defendant B paid interest on the loan obligations of our bank each month.

Defendant B: (a) on September 1, 2006, determined on KRW 20,000,000, monthly rent of KRW 1,200,000 among the instant real property; (b) on September 10, 2006, Defendant B leased 40 square meters among the instant real property at KRW 30,000,000, monthly rent of KRW 1,600,000; and (c) on September 10, 2006, Defendant B paid KRW 2,80,000, monthly rent of KRW 1,200,000 (= KRW 1,20,000,000).

On April 5, 2006, the Plaintiff entered into a contract with the Plaintiff for construction works and the Plaintiff’s payment of the construction cost under the name of the Defendant B, under which the Plaintiff contracted the instant construction work to the 1,493,800,000 won for the construction cost (including value-added tax; hereinafter “the construction cost of this case”).

The Plaintiff paid 50,000,000 won, around June 9, 2006, around 15, 2006, KRW 10,000,000, and KRW 15,000,000 on June 15, 2006, and KRW 75,00,000 on June 23, 2007 (= KRW 50,000,000,000). The Plaintiff paid 10,000,000 on June 23, 2007, from Defendant C.
