All appeals filed by the defendant and prosecutor are dismissed.
Reasons
1. Summary of grounds for appeal;
A. Defendant 1) Defendant 1’s assertion of mistake of facts did not directly prove that the Defendant: (a) there was no direct evidence that the Defendant committed a prefabricated sand position panel house (hereinafter “instant house”); (b) the Defendant’s statement without consistency was old to keep the Defendant’s cell phone in the J; and (c) notwithstanding the fact that the Defendant’s mobile phone was stored, the lower court found Defendant guilty of charges by mistake of facts; (b) the sentence (one year and six months of imprisonment) sentenced by the lower court against the Defendant on the ground of unfair sentencing is too unreasonable.
B. The sentence imposed by the prosecutor by the court below against the defendant is too unfortunate and unfair.
2. Determination
A. 1) The court below also asserted the same purport as the reasons for appeal, and the court below rejected the above argument in the "judgment on the defendant's and his defense counsel's assertion" in detail. In comparison with the evidential materials, the judgment of the court below is just in its determination since it can be sufficiently recognized that the defendant committed a fire insurance contract to prevent the house of this case and caused D to claim fire insurance money. In addition, considering the following circumstances acknowledged by the evidence of the court below at the time of the court below, the court below's finding the defendant guilty of the facts charged on the grounds as stated in the judgment below is just and there is no error of law by misunderstanding the facts and affecting the conclusion of the judgment.
① The Defendant stated in the trial court that “the situation in which the Defendant disposed of goods within the instant house immediately before the occurrence of fire and moved to container stuff would have taken his/her own photograph.” The Defendant’s neighbor also took CCTV photographs installed to prevent the theft of his/her house, against the instant house, three hours prior to the occurrence of fire.
