1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Defendant is a local organization of B organization established for the purpose of improving D status, protecting the rights and interests of D, promoting activities of E, etc. (hereinafter “instant association”). The Plaintiff is a director of the instant association and the head vice-chairperson of the Defendant.

B. When the Plaintiff was investigated by the police and the prosecutor with respect to the corruption of the F Hospital run by the Plaintiff, and the investigation announcement was reported to several media, on October 8, 2014, the Plaintiff submitted to the Defendant a letter of resignation stating that “the Plaintiff shall resign as an officer of the Association and a member of the Defendant” (hereinafter “instant letter of resignation”) and reached the Defendant around that time.

On December 18, 2014, the Defendant convened a temporary board of directors to fill the vacancy of officers of the Association of this case caused by the Plaintiff’s withdrawal from office, and decided to recommend G as its executive officers once after obtaining approval from the general meeting.

[B] Article 7 (Admission and Withdrawal of Members) (1) Members may join and withdraw from the Association at will.

(2) Any person intending to join the Association as a member shall submit an application for membership to the Association and obtain approval from the Council.

(3) Qualifications for members shall be granted when the prescribed membership fees, such as membership fees, are paid within a period designated after obtaining approval of the board of directors under paragraph (2).

(4) A member who intends to withdraw from the Association shall express his/her intention in writing to the Association.

[Members and membership fees regulations] Article 6 (Admissions) Members may freely join at any one branch in which the head office, factory or place of business is located.

In such cases, the member shall not be discriminated against in another branch because of the attendance and withdrawal of the specific branch.

Article 7 (Withdrawal of Members) (1) If a member intends to withdraw, he/she shall submit a written withdrawal to the branch to which he/she belongs.

(2) A branch in receipt of a written withdrawal of a member shall be the board of directors every month.
