Defendant
A shall be punished by a fine for negligence of KRW 1,000,000, and by a fine of KRW 1,000,000.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
Defendant
A is a licensed real estate agent who obtained qualification as a licensed real estate agent around May 2002 and registered to establish a brokerage office in the name of E licensed real estate agent under the name of the first floor D 120 of the first floor D 1, Goyang-gu, Seoyang-si, Seoyang-si, 2009, and Defendant B is a brokerage assistant who works together with Defendant A.
1. No defendant A licensed real estate agent may allow another person to render brokerage services using his name, or transfer or lend his certificate of licensed real estate agent to another person;
Nevertheless, around December 2009, the defendant agreed to distribute the fee received from the defendant B and the client at the above E Licensed Real Estate Agent Office at the rate of seven to three percent, and lent the qualification certificate of licensed real estate agent in the name of the defendant so that B may use the defendant's name to act as a broker.
2. Defendant B
(a) No person who violates the prohibition against lending, etc. of qualification certificates shall take over or take over by lending, etc. a qualification certificate of licensed real estate agent;
1) On September 26, 2011, the Defendant: (a) obtained a licensed real estate agent qualification certificate in his name from Defendant A to arrange to lease a commercial building No. 3A-115 of the H building No. 3A-15 of the Yongsan-gu Seoul Metropolitan City H building No. 3A-115 in the place indicated in paragraph (1); and (b) received KRW 5,40,000 from the said I as a commission. (c) On November 14, 2011, the Defendant, at the place described in paragraph (1) as above, arranged to lease the commercial building No. 3-202 of the Yongsan-gu J building No. 3 of the Yongsan-gu Seoul Metropolitan City J building No. 3 which is owned by the FFF Association and Construction Corporation; and (d) received 6,300,000 won from K.
Accordingly, the defendant used the real estate agent's license granted by the defendant A twice.
(b)The broker, etc. violating the prohibited acts of the broker, etc. shall cause the client's judgement by means of false words and behavior or other means concerning important matters relating to the transaction of the object of brokerage;
