1. The Defendant shall acquire by prescription on September 11, 2015, with respect to the Plaintiff’s share of 21/21 square meters of the 73 square meters of the roads Jincheon-gun, Jincheon-gun, Chungcheongnam-do.

1. Indication of Claim: On July 11, 1995, C (D Co., Ltd.) purchased 73m2 from the Defendant and E’s referring F to the Defendant and E, and the Plaintiff purchased and possessed the above road from C on June 16, 199.

C and the Plaintiff’s period of possession completed on July 11, 2015 after the lapse of 20 years after adding up the period of possession. As such, the Plaintiff seek implementation of the registration procedure for transfer of ownership based on the completion of the prescription for possession to the Defendant.

In claiming the completion of the statute of limitations for the acquisition of land with no change in the owner’s possession, the prescriptive period may be quoted as of September 15, 2015, regardless of where the starting point of the possession is the starting point, only when the prescriptive period has elapsed by evidence (see Supreme Court Decision 90Meu16723, Nov. 9, 190).
