Reasons
Punishment of the crime
1. On July 5, 2019, the Defendant, on the part of the victim AF, posted a false statement to the effect that “AG,” a website for high-speed trading, sold a Grand Man-Manis on the bulletin board of “AG,” thereby making a false statement to the effect that “the remittance of money, would send clothes to the victim.”
However, in fact, the Defendant did not have stonaland Man-Maur, and even if receiving money from the victim, there was no intention or ability to send the said things to the victim because he thought to use it for living expenses, etc.
As above, the Defendant, by deceiving the victim, received 150,000 won from the victim to the AH account (Account Number: AI) in the name of the accused on the same day, and acquired it.
2. 피해자 AJ에 대한 범행 피고인은 2019. 8. 12. 인터넷 중고거래 사이트인 ‘J’ 게시판에 ‘나이키 X 스캇 에어조던1 로우 운동화를 판매한다.’는취지의 글을 게시하여 이를 보고 연락한 피해자 AJ에게 ‘돈을 송금하면 운동화를 보내주겠다.’는 취지로 거짓말을 하였다.
그러나 사실 피고인은 나이키 X 스캇 에어조던1 로우 운동화를 가지고 있지 않았고, 피해자로부터 돈을 받더라도 이를 생활비 등에 사용할 생각이었으므로 피해자에게 위 물건을 보내줄 의사나 능력이 없었다.
