Reasons
1. Basic facts
A. The Plaintiff is the owner of B 65 tons of a flag (hereinafter “instant flag”) who runs construction machinery rental business under the trade name of “C”.
B. The Defendant purchased the facilities (batch plan, stilo, and other military units) of the ready-mixed factory located at the D construction site that is constructed by the MaMAel Construction Co., Ltd., and performed the construction of the Defendant’s factory to move to another factory (hereinafter “instant construction”) by demolishing the facility of the above ready-mixed factory.
C. On December 31, 2015, the Plaintiff sent the Plaintiff’s 50 tons loader with the driver E at the instant construction site, and E operated the said 50 tons loader, and dismantled the batch development plan on December 31, 2015.
In addition, on January 5, 2016, January 6, 2016, and January 8, 2016, the Plaintiff sent the instant weighter to the instant construction site, along with a driver F. F. The F operated the instant weighter on January 5, 2016, and dismantled the batt facilities on January 6, 2016 and January 8, 2016.
