The defendant shall be innocent.

1. The summary of the facts charged [2014 Highest 1031] The Defendant, as the owner of B vehicle, had C, an employee, operate the said vehicle at the high value of sand located in the Seodaemun-gu Seoul Metropolitan Government Scar on October 14, 2004, the total weight of which exceeds four tons.

[2014 Highest 1035] The Defendant, as the owner of D vehicle, had E, an employee, operate the said vehicle more than 4.1 ton of total weight around 15:00 on July 28, 2003.

[2014 Height 1041] The Defendant, as the owner of F Car Truck, had his employee G drive the said vehicle more than 0.21 meters at a point of 32.2 km in the direction of publication of the coast Highway on February 16, 2004, around 07:55.

[2014 Highest 1045] The Defendant, as the owner of H 15 tons of H, had I, an employee, operate the said vehicle in excess of 3.4 tons at Acheon-dong 21-1, Acheon-si on February 7, 2003.

[2014 Highest 1051] The Defendant, as the owner of B 15 tons dump truck, had J, an employee, operate the said vehicle in excess of 2.7 tons and 2.4 tons at the 3th dump dump dump dump dump dump dump dump dump dump dump dump dump dump dump on August 20, 201.

[2014 Highest 105] On August 26, 2000, at around 08:38, the Defendant used G to operate K 16 tons more than 10.4 tons more than 10 tons more than 16 tons more than 10 tons more than 16 tons more than 10 tons more than 16 tons more than 16 tons at the road in front of the Dong-ri-ri metropolitan highway.

2. The above facts charged fall under Articles 86, 83(1)2, and 54(1) of the former Road Act. However, according to the decision of the Constitutional Court of Korea as to Article 86 of the former Road Act that "where an agent, employee, or other worker of a corporation commits a violation provided for in Article 83(1)2 with respect to the business of the corporation, the corporation shall also be punished by a fine provided for in the corresponding Article."
