B Imprisonment with prison labor of one year and six months, and Defendant A shall be punished by imprisonment with prison labor of eight months.
However, as to Defendant A, this shall not apply.
Reasons
Punishment of the crime
The telephone financial fraud (hereinafter referred to as the "scaming") organization consists of: (a) the inducement of the victims by deceiving the victims by means of making a telephone to an unspecified number of victims or misrepresenting them to an investigation agency; (b) the delivery of the means of access, such as the physical card connected to the bank passbook; (c) the delivery of the means of access, such as the check card connected to the bank passbook; (d) the withdrawal of the amount of damage from the delivery of the said means of access; and (e) the remittance of the amount of damage from the said withdrawal; and (e) the remittance of the amount of damage to the said organization.

B On November 2018, 2018, a police officer conspireds with a name-free person to deliver the said amount of damage to the Defendant’s account as directed by the Organization of Bosings upon delivery of the said amount of damage to Bosingsing, and Defendant A, on April 2, 2019, under the contact with the Defendant that the said amount of damage to the said account was a crime of Bosing the said amount of damage, informed the Defendant of personal information, such as the account number, etc. of the C Bank account (Account Number: D) opened in his name at the request of the said solicitation book, with the knowledge that the said solicitation book was committed, and agreed to facilitate the said fraud by withdrawing the amount of damage to Bosing deposited in the said account in accordance with the direction of the said solicitation book and delivering it to Defendant B.
