1. The defendant A shall be punished by imprisonment for eight months and by imprisonment for six months; and
2.Provided, That this ruling shall become final and conclusive, respectively.
Reasons
Punishment of the crime
According to the proposals of D, E, F, etc. that operate a private sports entertainment site, the Defendants conspired to receive a certain amount of money from the members of the relevant site for the use of betting money and charge the money for the use of betting money, and to participate in the crime of giving a refund according to the dividend rate to the members who meet the result of various domestic and foreign sports games.
From April 20, 2013 to September 3, 2014, the Defendants recruited a large number of members while operating a name H and I site, which is a private sports soil entertainment site in Vietnam, from around 2013 to around 3, 2014, and then transferred KRW 132,037,00 from members to the bank account in the name of J, such as in the list of crimes attached hereto, and deposited KRW 132,037,00 with the betting money, and caused members to predict the winning of various domestic and foreign sports games at least KRW 5,00 at a minimum of KRW 1,00,000 at one time, and the members were to receive a maximum of KRW 1,00,000 in the amount of betting money in accordance with the set dividend rate, and then members were to participate in the crime of filling KRW 16 in the total account,8,51,105,105,050 in the same way as the attached crime list.
Defendant
A from May 6, 2013 to October 18, 2014, from the office located in Vietnam to the management of charging prior to the filling, sports registration, and closure, website bulletin board, or recruitment of “large passbook”, cash withdrawal, and illegal income withdrawal, etc., Defendant B from March 13, 2014 to June 19, 2014, respectively.
As a result, the Defendants conspired with the above D, etc. to provide property or financial benefits to persons who win the result by issuing sports betting tickets or similar things, even if they are not entrusted business operators.
