1. Defendant A’s KRW 1,440,370,000 and the Plaintiff’s annual rate of KRW 5% from May 20, 2016 to March 22, 2017.
Reasons
1. Basic facts
A. The Plaintiff is a corporation established under the Korea Highway Corporation Act for the purpose of the construction, management, etc. of roads, and the Plaintiff is delegated by the Minister of Land, Transport and Maritime Affairs to the Minister of Land, Transport and Maritime Affairs.
2) Defendant A is the driver of the Fro vehicle owned by E (hereinafter referred to as the “instant sea vehicle”) and Defendant B is the driver of the G 25 tons tank truck (hereinafter referred to as the “instant tank”) owned by Defendant C.
3) Defendant C, a company running a trucking transport brokerage business, is the user of Defendant B and the owner of the tank lock, and the Defendant Federation is the mutual aid business entity that entered into a motor vehicle mutual aid agreement with Defendant C with respect to the tank lock vehicles. (B) In the event of a fire accident, Defendant A driven a sea-going vehicle around 11:30 on May 20, 201, while driving the expressway at a point 117km in Seoul (hereinafter “instant accident point”) in the direction of Seoul on the expressway, Defendant C changed the vehicle from the first lane to the second lane, and discovered a numberless passenger vehicle (hereinafter “numberless passenger vehicle”) in order to avoid a collision, the steering gear was changed to the left side of the vehicle, and the plucking vehicle of the Defendant B while driving the vehicle from the fourth lane to the right side.
