A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2018 Punishment No. 37326]

1. On April 2017, the Defendant openly displayed obscenity, including F, etc., 30 children and juveniles, by operating a obscene site called “D site (D)” for the purpose of gaining advertising profits at the residence located in building B B in the Nam-gu Incheon Metropolitan City Building C, on the bulletin board of the said site, by posting a notice of “F,” which contains a face where a person clearly recognizable as a child or juvenile is exposed to a sound, etc., who is able to be obviously perceived as a child or juvenile, and by posting a notice of “F,” etc., until July 2018, the Defendant openly displayed 30 obscene materials used by him/her, as shown in the attached Table 1.

2. On April 2017, the Defendant operated a obscenity site called “D site (D)” for the purpose of gaining advertising profits at the same residence as indicated in paragraph (1) of the same Article, and posted a notice of the appearance of male and female on the bulletin board of the above website’s sexual act of sexual intercourse within the main place, and distributed 39 photographs of a total of 39 photographs, such as a list of crimes, from July 2018, by the following day: (a) the Defendant distributed 29 photographs, such as a list of crimes, from July 2018.

3. On April 2017, the Defendant operated a obscene site called “D site (D)” at the same residence as indicated in paragraph (1) of the Act on Promotion of the Use of Information and Communications Network and Information Protection, Etc. (obscenity distribution) and posted a notice on the bulletin board of the said site of obscene images of “H” including the face of sexual intercourse with the face of sexual intercourse. By July 2018, the Defendant displayed a total of 176 obscene images and videos, as shown in attached Table 3.

[2] From July 11, 2017, the Defendant operated an obscene site called “I site (I)” at the residence located in the building B B of the Nam-gu Incheon Metropolitan City building B from around July 11, 2017. On October 9, 2017, the Defendant posted a motion picture of “K” containing a face of gender doing sexual intercourse on the website’s J bulletin board to the public.
