피고인은 2013. 1. 18. 04:15경 제천시 B에 있는 제천경찰서 C지구대 안에서, B 술집에 출동한 경찰관들이 신고처리 업무를 편파적으로 하여 억울하다며 택시를 타고 찾아와 현장에 출동했던 경찰관을 불러달라며 항의하던 중 피해자인 제천경찰서 C지구대 소속 경위 D가 우리지구대 경찰관은 신고 출동한 사실도 없고 옆 지구대에도 그런 사실이 없다며 귀가하라고 했다는 이유로 택시기사인 E과 경찰관 3명이 있는 자리에서 피해자에게 “야 이 새끼야 나를 뭘로 보느냐, 병신 육갑떨고 있네”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
