Reasons
1. Basic facts
A. From November 8, 2010, Defendant D, as the president of Defendant EFF (hereinafter referred to as “EFF”) from November 8, 2010, took charge of the overall affairs of the head office and branch offices on behalf of the NAF on behalf of the head office of the EF (hereinafter referred to as “the network”). From August 23, 2010 to the head office of the EF, Defendant D took charge of affairs such as agricultural product disaster insurance, agricultural guidance, and economic projects.
B. The plaintiff A is the wife of the deceased, and the plaintiff B and C is the deceased's children, and the succeeding intervenor of the plaintiff A (hereinafter "the succeeding intervenor") is a corporation established under the National Pension Act for the purpose of providing pension benefits for old age, disability, or death of the people, and managing and operating national pension projects.
C. During the process of paying KRW 1,86,00,00 for crop disaster insurance proceeds due to spring injury in 2011, the Ministry of Agriculture, Forestry and Fisheries instructed H in charge of paying disaster insurance proceeds of KRW 112,206,026,00 to the deceased and G branch in charge of paying disaster insurance proceeds of the Ministry of Agriculture, Forestry and Fisheries in order to avoid the resistance of farmers, and the Defendant D instructed H in charge of paying disaster insurance proceeds of KRW 112,206,00 among insurance proceeds to be paid to high-amount recipients of insurance proceeds according to the above direction, the deceased and H paid insurance proceeds of KRW 112,200 to farmers who are not recipients of insurance proceeds.
However, since July 12, 2012, when a civil petition related to the foregoing accident insurance money was filed, the deceased received serious resistance from many farmers. From July 17, 2012 to July 19, 2012, the National Headquarters of the Gyeongbuk Regional Headquarters of Agricultural Cooperatives was audited by the inspector, while the above accident insurance money was paid on July 24, 2012.
