A defendant shall be punished by imprisonment for not more than ten months.

The fifty-three days of detention before this judgment is sentenced shall be included in the above sentence.

Punishment of the crime

1. The Defendant did not have any property collected, and the Defendant was in a bad credit standing status since early 2006 because he was unable to repay obligations worth KRW 10 million, and there was no intention to marry with the victim C (the age of 26) without filing a marriage report.

Nevertheless, on March 6, 2007, the defendant had sexual intercourse with the victim on the part of the victim's home on the following day by making the victim's "a person who has a domicile in Incheon if he/she gets married or married to her." He/she sold his/her home and prepared a house in Seoul to believe it." On the same day, the defendant had sexual intercourse with the victim who does not know the name of the wife of the E-university located in Gwangjin-gu Seoul Special Metropolitan City, and who did not habitually engage in sexual intercourse with the victim who did not know of his/her sex.

In addition, the Defendant, from March 6, 2007 to December 31, 2007, had sexual intercourse with the victim by having sexual intercourse with the victim by the same method 36 times as shown in the annexed crime sight table (1).

2.(a)

The defendant did not have any specific income other than 1.2 million won as a monthly income, and there was no specific property in the name of the defendant, and because he was unable to pay 10 million won personal debts, he was under the circumstances of bad credit standing from the beginning of 2006, he did not have any intention or ability to complete payment even if he borrowed money from others.

Nevertheless, on March 26, 2007, the Defendant made a false statement to the victim C, stating that “If a bridge is to go to an Ampha Hospital because there is no hospital expenses, the Defendant would write KRW 1,000,000 and complete payment on a monthly salary in the following month.”

The Defendant, by deceiving the victim, received the victim’s Samsung Card (F) from the victim on the same place, and purchased goods, etc. in the aggregate amounting to KRW 12,845,439 on 107 occasions from March 27, 2007 to January 2, 2008, and approved it by the said credit card.
