Reasons
Punishment of the crime
[Criminal Power] On Nov. 19, 2009, the Defendant was sentenced to eight months of imprisonment for a violation of the Trademark Act by the District Court of Jung-gu on Apr. 11, 2010, and completed the execution of the sentence in the medical prison.
【Criminal Facts】
피고인은 2012. 8. 14.경부터 2012. 9. 26.경까지 서울 강북구 C빌라 202호에서 속칭 ‘짝퉁’상품 보관창고를 운영하면서, 성명불상자들에게 상표권자 ‘샤넬’의 등록상표인 ‘CHANEL'(상표등록번호 D)과 동일한 모양의 위조상표가 부착된 가방 5점(정품추정시가 합계 25,000,000원 상당), 상표권자 루이비똥 말레띠에’의 등록상표인 ‘LOUIS VUITTON'(상표등록번호 E)과 동일한 모양의 위조상표가 부착된 가방 15점(정품추정시가 합계 27,000,000원 상당)을 판매하고, 2012. 9. 26.경 F에게 ’LOUIS VUITTON' 상표가 부착된 지갑 10점(정품추정시가 합계 5,000,000원 상당)을 판매하고, 2012. 9. 26.경 위 보관창고에서 판매할 목적으로 ‘LOUIS VIOUTTON'과 동일한 모양의 위조상표가 부착된 가방 136점(정품추정시가 합계 244,800,000원 상당)을 비롯한 별지 범죄일람표 기재의 위조 유명상표 부착상품 224점(정품추정시가 합계 433,900,000원 상당)을 보관함으로써 위 상표권자들의 상표권을 각 침해하였다.
