A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. No one shall engage in, or arrange for, the conduct of sexual intercourse using any part of the body, such as the sexual intercourse or the mouth and anus, in return for giving or receiving, or promising to give or receive, money, valuables or other benefits to an unspecified person, and make use of any similar sexual intercourse using any of the body or implements, or arrange for the conduct of sexual intercourse;
Nevertheless, on July 2019, the Defendant employed a foreign woman within the name of "B" as an employee in the middle of the police station, and received KRW 9-350,000 for each course from an unspecified number of male customers, and provided the said employees with the above-mentioned employees to have sexual intercourse with the said customers by leading them to the above-mentioned employees (i.e., sexual intercourse), or (ii) had the said employees make the business trip to the place designated by the customers to have the said employees to have sexual intercourse with the said customers (hereinafter referred to as "daily business trip").
On August 2, 2019, at around 20:20 on August 2, 2019, the Defendant: (a) assisted female employees (e.g., trade name D) who have been employed by themselves to engage in sexual intercourse with male customers; (b) around that time, from around September 16, 2019 to around 170 times, the Defendant received 9-230,000 won from many unspecified customers who had been employed by themselves to have sexual intercourse with the said customers.
Accordingly, the defendant, as a business, committed acts such as arranging sexual traffic.
2. A foreigner who violates the Immigration Control Act intends to find a job in the Republic of Korea shall obtain the status of sojourn eligible for employment activities, as prescribed by Presidential Decree, and no person shall employ a person who has no status of sojourn eligible for employment activities;
Nevertheless, the Defendant from July 24, 2019 to July 25, 201 and July 2019.
