1. Interference with business and obstruction of performance of official duties;

A. At around 18:21 on April 27, 2019, the Defendant: (a) expressed, without any justifiable reason, at the D restaurant operated by the victim C in the racing-si B, the Defendant ordered food under the influence of alcohol; and (b) expressed, “I see this ring, E, E, F, etc.,” and “I see, E, E, etc., such a restaurant,” and expressed, “I see, E, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I see, I am on the floor of the restaurant.”

나. 피고인은 2019. 4. 27. 18:59경 위 장소에서, “손님이 행패를 부린다.”라는 112신고를 받고 현장에 출동한 G파출소 소속 경찰관인 경위 H으로부터 위와 같이 소란을 피우는 것을 제지당하자 화가 나 H에게 “야 이 씹할놈아, 개새끼들아, 짭새 씹할놈들이 왜 왔냐.”라고 욕설을 하고, H으로부터 인적사항에 대한 질문을 받자 격분하여 주먹을 H을 향하여 2회 휘둘렀다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers concerning the handling of 112 reported cases.

2. Violence and obstruction of performance of official duties;

가. 피고인은 2019. 4. 28. 12:14경 경주시 I에 있는 G파출소 앞 도로에서, 술에 취한 상태로 길을 가던 중 아무런 이유 없이 우즈베키스탄 국적의 외국인인 피해자 J(35세)에게 시비를 걸면서 양손으로 피해자의 멱살을 잡아 흔들고, 피고인을 피하여 달아나는 피해자를 쫓아가 주먹으로 피해자의 얼굴을 1회 때리며, 발로 피해자의 가슴을 1회 걷어찼다.

Accordingly, the defendant assaulted the victim.
